Les présentes Conditions Générales d’Utilisation (CGU) régissent l’utilisation des applications CartoExplorer (ci-après « les Applications ») et du site internet associé https://www.cartoexplorer.com (ci-après « le Site »), (ci-après désignés ensemble l’« Écosystème »), exploités par CartoExplorer (ci-après « l’Éditeur »).
En accédant à l’une des Applications ou au Site, l’Utilisateur accepte pleinement et sans réserve les présentes CGU.
Si vous n’acceptez pas ces conditions, veuillez ne pas utiliser nos services.

L'Écosystème CartoExplorer est accessible gratuitement. Des abonnements proposés par l’Éditeur permettent de débloquer certaines fonctionnalités.
L'achat de ces abonnements est soumis aux Conditions Générales de Vente (CGV) de CartoExplorer, disponibles sur le site https://www.cartoexplorer.com.
Avant de procéder à l'achat d'un abonnement, l'Utilisateur doit lire attentivement et accepter les CGV.
Les CGV définissent notamment les modalités de commande, de paiement, de renouvellement et de résiliation des abonnements, ainsi que les droits et obligations de l'Éditeur et de l'Utilisateur.
L’Éditeur met tout en œuvre pour assurer la disponibilité des Services.
Toutefois, CartoExplorer décline toute responsabilité si l’accès à son Écosystème est temporairement suspendu pour des raisons extérieures, de maintenance ou en cas de force majeure.
Pour toutes les questions liées à un problème lié a l'Ecosysteme ou au site internet (téléchargement, achat,bug, ...) l’Utilisateur est invité à envoyer un email à l’adresse email suivante :
L’Utilisateur s’engage à :
- Ne pas utiliser l’Écosystème à des fins illégales ou contraires aux bonnes mœurs.
- Ne pas porter atteinte aux droits de propriété intellectuelle de l’Éditeur ou de tiers.
- Fournir des informations exactes lors de l’inscription (le cas échéant).
Il est strictement interdit de :
- Tenter d’accéder de manière non autorisée à des parties de l’Écosystème.
- Extraire, copier ou reproduire les données cartographiques sans autorisation préalable de l’Éditeur.
Tous les contenus (textes, images, cartes, logos, éléments graphiques, code, etc.) présents sur les Applications et le Site sont protégés par les lois relatives à la propriété intellectuelle.
Toute reproduction, représentation ou exploitation non autorisée des contenus est strictement interdite.
CartoExplorer s’engage à protéger la vie privée des Utilisateurs et à traiter leurs données personnelles dans le respect de la Réglementation Générale sur la Protection des Données (RGPD) et de la loi Informatique et Libertés.

CartoExplorer ne saurait être tenu responsable des dommages directs ou indirects résultant de l'utilisation de l'Écosystème, notamment en cas d'erreur, d'omission, d'interruption de service ou de problème technique.
L'Utilisateur est seul responsable de sa sécurité lors de sa pratique. Les informations fournies par l’Écosystème ne sauraient remplacer le bon sens et les règles de prudence élémentaires.
Pratiquer une activité en extérieur est potentiellement dangereux et peut parfois entraîner des blessures, voire la mort.
L’Utilisateur de l’Application est entièrement responsable de son activité et se doit de savoir anticiper les dangers potentiels.
Il doit :
- Savoir évaluer sa capacité physique
- Se tenir au courant des conditions météorologiques, locales notamment, et de praticabilité du secteur dans lequel il souhaite évoluer.
CartoExplorer ne saurait aucunement être tenue pour responsables de la non-réussite par l’Utilisateur de ses objectifs, ou de tout autre incident, accident, blessure ou mort survenus sur le terrain.
L’Utilisateur est seul responsable de l’interprétation et l’utilisation des informations fournies par l’Application pour profiter en toute sécurité de sa sortie.
CartoExplorer rappelle qu’une assurance individuelle contre les accidents corporels est vivement conseillée pour la pratique d'activités comportant un risque corporel. Cette assurance doit être souscrite à titre personnel auprès d’un assureur par l’Utilisateur.
Il est également conseillé à l’Utilisateur de se renseigner sur les conditions des secours et de rapatriement en vigueur dans le secteur, le pays où il décide de pratiquer son activité.
L’Éditeur se réserve le droit de modifier les présentes CGU à tout moment. Les modifications entrent en vigueur dès leur publication sur le Site ou l’Application. L’Utilisateur est invité à consulter régulièrement les CGU.
Les présentes CGU sont régies par la loi française. Tout litige relatif à leur interprétation ou exécution relève de la compétence exclusive des tribunaux français.

These General Terms and Conditions of Use (GTU) govern the use of CartoExplorer applications (hereinafter "the Applications") and the associated website https://www.cartoexplorer.com (hereinafter "the Website"), (hereinafter collectively referred to as the "Ecosystem"), operated by CartoExplorer (hereinafter "the Publisher").
By accessing one of the Applications or the Website, the User fully and unreservedly accepts these GTU.

The Applications and the Website are accessible free of charge. Subscriptions offered by the Publisher allow to unlock some features.
The purchase of these subscriptions is subject to CartoExplorer's General Terms and Conditions of Sale (GTCS), available on the website https://www.cartoexplorer.com.
Before proceeding with a subscription purchase, the User must carefully read and accept the GTCS.
The GTCS define in particular the terms and conditions of ordering, payment, renewal and termination of subscriptions, as well as the rights and obligations of the Publisher and the User.
The Publisher makes every effort to ensure the availability of the Services.
However, CartoExplorer declines all responsibility if access to its Ecosystem is temporarily suspended for external reasons, maintenance or in case of force majeure.
For all questions related to a problem with the Ecosystem or the website (download, purchase, bug, ...), the User is invited to send an email to the following address :

- Not use the Ecosystem for illegal or immoral purposes.
- Not infringe the intellectual property rights of the Publisher or third parties.
- Provide accurate information when registering (if applicable).
It is strictly forbidden to :
- Attempt to gain unauthorized access to parts of the Ecosystem.
- Extract, copy or reproduce cartographic data without prior authorization from the Publisher.
All content (texts, images, maps, logos, graphics, code, etc.) present on the Applications and the Website is protected by intellectual property laws.
Any unauthorized reproduction, representation or exploitation of the content is strictly prohibited.
CartoExplorer is committed to protecting Users privacy and processing their personal data in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act. For more information, please consult our Privacy Policy : here.
CartoExplorer cannot be held responsible for direct or indirect damage resulting from the use of the Ecosystem, in particular in the event of error, omission, service interruption or technical problem.
The User is solely responsible for their safety during their practice. The information provided by the Ecosystem cannot replace common sense and basic safety rules.
Practicing an outdoor activity is potentially dangerous and can sometimes lead to injury or even death. The User of the Applications is entirely responsible for his activity and must know how to anticipate potential dangers.
He must :
- Know how to assess his physical capacity.
- Keep informed of the weather conditions, particularly local ones, and the practicability of the area in which he wishes to move.
CartoExplorer cannot be held responsible in any way for the failure of the User to achieve his objectives, or for any other incident, accident, injury or death occurring in the field. The User is solely responsible for the interpretation and use of the information provided by the Applications to safely enjoy his outing.
CartoExplorer reminds that personal accident insurance is strongly recommended for the practice of activities involving bodily risk. This insurance must be taken out personally by the User with an insurer.
The User is also advised to inquire about the conditions of rescue and repatriation in force in the sector, the country where he decides to practice his activity.
The Publisher reserves the right to modify these GTU at any time. The modifications come into effect upon their publication on the Website or the Application. The User is invited to consult the GTU regularly.
These GTU are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the French courts.
